iLaaik SA and its Internet domain www.ilaaiksa.co.za is fully owned by Digibali Productions CC, registration CK 2006/011688/23.

iLaaik SA, in this context known as the “master domain” has 14 domains associated with it and in this context they are known as the “related domains”.

iLaaik SA also means www.ilaaiksa.co.za . The same principle applies to all the related domains, i.e. iLaaik Garden Route also means www.ilaaikgardenroute.co.za and so with all the related domains.

All the related domains towns that resort under the domain www.ilaaikgardenroute.co.za fall within a geographical region of the Western Cape province of South Africa known as the Garden Route. This geographical region is demarcated for this website by the towns forming the outer boundaries of the region namely Mossel Bay and Plettenberg Bay. Plettenberg Bay includes all residential and business areas along and immediately off the N2 all the way up to Nature’s Valley to the east.

The term “website” refers to the domain www.ilaaiksa.co.za and all its related domains unless otherwise stated.

In the language of these terms and conditions Digibali Productions CC is also referred to as Digibali or the term Internet publisher.

What are iLaaik SA and its related domains?

iLaaik SA and its related domains are interactive websites that allows people to contribute content to the websites either free or paid for on a monthly to yearly basis. The term “paid for content” is henceforth known as “paid content” or “subscription”.

A current subscription refers to a business listing that is live and had not fallen into arrears in terms of the payment conditions relating to the subscription.

Purpose, mission and aim

The express purpose, mission and aim of this website are to act as a community business and social forum for promoting the towns which are incorporated in the Garden Route.

Informational content on the website can have tourism, commercial communications and general entertainment value. All posted content should aim to align with the purpose, mission and aim of this website.

All content will be monitored for quality purposes. Individuals abusing the system will or may be removed without prior warning. All registered users will be able to report inappropriate content.

A user maliciously reporting content that is appropriate as inappropriate is regarded as an act of posting abusive content and thereby it will be considered inappropriate and will be dealt with in the same manner of posting of abusive content.

Posting free content

Posting free content should have value in its relevancy to the purpose, mission and aim of this website. Relevant content means commercial business listings and all posting categories related to and available under the button “create your own content”.

Publishing on iLaaik

All posted content by registered users, also known as the “original publisher”, must be respected and be considered the intellectual property of such a publishing user. Digibali maintains and reserves the publishing rights of all content posted until it is removed by the original publisher who would also be a registered user.

All content posted by registered users for any form of remuneration becomes irrevocably the property of Digibali. Such content may only be removed by means of a majority decision of shareholders. All content posted on any of the related domains may not be downloaded for publication elsewhere without the written permission of the majority shareholders.

Digibali also retains the rights to remove any content without prior warning if it is not deemed relevant to the purpose, mission and aim of this website.

Digibali also retains the rights to archive posted content, edit posted content or even remove posted content if it is deemed to be for the greater good and service to all users and in particular to users with published paid content.

Paying for content

Paid content on the website is charged at the current maximum fee of R684 per year or R57 per month or multiples of the monthly subscription dependent on the number of months chosen by the user for the subscription.

All monetary figures or sums quoted are inclusive of VAT charged at 14%.of the total amount paid.

If you have paid any amount less than the current business listing value of R684 it would be as a result of a gratuity or discount coupon entered into our database by an iLaaik representative.

Methods of payment are online credit card payment, bank transfer or EFT, cash on delivery (C.O.D), or debit order via www.netcash.co.za .

The term R684 or R57 or its multiples refers to the amount in rand in valid South African currency. Any foreign currency received must be equal to or more than its value in rand.

The current fee of R684 or R57 or its multiples for new subscriptions may change without prior notice or warning. If you own a current paid subscription a price hike will not affect your account for the duration of your current subscription on condition that the subscription is not in arrears.

If a current subscription falls into arrears and is suspended and subsequently reinstated by means of payment received, the current fee R684 or R57 or its multiples may take affect and the discount or gratuity voucher may no longer be valid.

Business listing suspensions

The website you are on is a fully automated system. It receives payment, auto-generates invoices, sends notifications and suspends unpaid business listings automatically. Behind the system are real people who care about your online presence. If you are experiencing financial difficulty kindly contact Digibali immediately after you have received your automated suspension message. In most cases we can assist.

5 days prior to the expiration date of your monthly, multiple monthly, yearly, two year or three year subscription you will receive a notification via e-mail that your new subscription is due.

After the actual expiry date the automated system will keep your subscription live for another 5 days after which it will expire and go offline.

What you pay for

Paid content entitles you to list the following contact details. Phone, mobile and fax numbers, email address and web address. The fields for this specific contact information are available in the Full Business listing content type. It also makes provision for the publication of logo or splash picture including 4 additional pictures.

Malicious content

The website allows registered users to upload clean and relevant content in terms of the prompted content fields. You are not allowed to attempt to infuse or upload to the website malicious ware or active content such as viruses or potentially harmful material of any kind or nature.

Liability

Digibali cannot be held responsible for any losses, financially or otherwise, arising from the website being offline for any period of time.

The website may be removed from the Internet (World Wide Web) without reason or prior notice. Although it is not in the interest of Digibali to do so the closed corporation reserves the right to take this action for reasons unforeseen or unexpected matters arising that renders the action of removal out of or beyond the owners’ control.

Digibali Procuctions CC or any of its members, representatives or employees cannot be held responsible for injury, death, financial loss or losses of any kind resulting from the use of this website or any related website owned by this Internet publisher.
